SUPPLY CONDITIONS CONTRACT FOR THE SERVICE www.casaincasa.com

Object: Request of adhesion tothe service www.casaincasa.com
The undersigned requests to be able to make use of the service casaincasa.com at the conditions quoted below, including those in the contract of adhesion following the present.
Access to the website and to the services www.casaincasa.com, without time limits for all the duration of the contract inforce, without activating costs and subscription fees.

CUSTOMER DATA

CONTRACT OF ADHESION TO THE SERVICE www.casaincasa.com COM OF CASA IN CASA S.A.S.
 1) SUPPLYING CONDITIONS: the supplying conditions are part and parcel of the present contract.
 2) OBJECT: Object of the present contract is the subscription to the service www.casaincasa.com
 3) USE OF THE SUBSCRIPTION: the client will be able to use the subscription for one single access, more than one connection at a time will not be possible. The system connected to www.casaincasa.com will not, in any case, have the function of gathering several users with the use of the services casaincasa.com on their part.
 4) PRIVACY: access to www.casaincasa.com is granted through a client identification code (UserName) and a password. The client must to keep the password strictly secret and with the utmost care. he will therefore be held responsible of any damage caused to www.casaincasa.com or to third parties depending on the disregard of what mentioned above. The client binds himself to notify the possible theft or loss of the password to Casa in Casa S.a.S., immediately and in written form.
 5) DOCUMENTATION: The client takes note of and accepts the existence of the electronic register of the activation of www.casaincasa.com (the "Log"), produced and kept by Casa in Casa S.a.S.. The content fo the Log is strictly reserved and it will be possible to show it only and exclusively at the competent Authority's request.
 6) GUARANTEES AND LIMITATION OF RESPONSIBILITY:the client takes upon himself the full responsibility regarding the correctness and truthfulness of the material put in, directly or on behalf of third parties, and ensures that the same is within his legitimate availability, that it is not contrary to the mandatory rules and does not violate any copyright, trademark, distinctive brand, invention patent or any other third parties' rights deriving from the Law, from the contract and/or from the custom. The client also takes note of the fact that it is forbidden to take advantage of www.casaincasa.com to carry out correspondence against moral laws and public order or with the purpose of molesting the public or private peace, to offend or to cause direct or indirect damage to anybody and for attempting at violating the secrecy of private messages in any way. In any case the doccomm generated by an Aldus applicationinformation supplied by the client must not present forms or contents of a pornographic, obscene, blaspheme or slanderous character. It is anyhow explicitly forbidden to take advantage of www.casaincasa.com in order to contravene the Laws in force, either in a direct or indirect way, in the Italian State or in any other State. The client guarantees Casa in Casa S.a.S. substantially and in trial proceedings, keeping it unharmed from any loss, damage, responsibility, cost or expense, including trial expenses, deriving from any violation of the above specified rules. Casa in Casa S.a.S. will not respond of dealys, malfunctionings, suspensions and/or interruptions - either towards the client or towards subjects firectly or indirectly connected to the same client - in the erogation of the services caused by:
   a) acts of God or accidental cases
   b) tampering or interventions on the services or on the machinery, done by clients or by third parties not authorized by Casa in Casa S.a.S.
   c) wrong use of the services by the client
   d) malfunctioning of the connecting devices used by the client
 7) EXPRESSED RESCINDING CLAUSE: By provision od article 1456 Casa in Casa S.a.S. keeps the faculty or rescinding by right the present contract, by means of a communication sent to the client through a 7 days forewarning notice registered letter, in case of non-fulfilment of even only one of the obligations included in Article 3 "Use of the Subscription", in Art. 4 "Privacy", in Art. 6 "Guarantees and Limitations of Responsibility". However it is mantained in any case the right to a refund of the possible damages suffered.
 8) DURATION AND FORFEITURE: The subscription to the service, starting from the dayof activation, has the fduration of one year and its renewal is tacitly agreed upon from year to year, except for cancellation by one of the parties to be communicated to the other part by means of registered letter or e-mail at least 30 days before expiry date. In case the client does not use his subscription for a period of time longer than 90 consecutive days, Casa in Casa S.a.S. retains the faculty of suspending the erogation of the service and of appointing the access Userld to another client.
 9) COMMUNICATIONS: All communications relevant to the present contract will be sent to Casa in Casa S.a.S. Servizio Gestione Contratti - 42018 San Martino in Rio R.E. It will also be possible to send the said communications to the e-mail addresses info@casaincasa.com.
 10) COMPETENT COURT: for the disputes relevant to this present contract, the Reggio Emilia Court of Law will be exclusively competent.
 11) ADJOURNMENTS, INDICTMENTS ACCORDING TO THE LAW: For what not contemplated in the present contract, the Laws in force will be applied.
 12) LAW 675/96: In fulfilment of Articles 10 and 11 of Law 675/96, bearing the dispositions for the safeguard of peorsons and other subjects with reference to the handling of personal data, the client states that he has received specific information and confirms the agreement already given online to www.casaincasa.com for the handling of his personal data, directly or also through third parties, in order both to comply with the obligations of the law, by a regualtion or by the community laws, and in particular to give complete fulfilment to all the contract obligations, also in view of the following further purposes with reference to the object of the contract:
  a) elaborating studies and market statistic researches
  b) sending advertising and informative material
  c) carrying out direct activities of sale or disposal
  d) sending trading information
  e) carrying out interactive trading communications

The undersigned declares that he has examined ad accepted the conditions of supply and the Contract of adhesion. According to the Article 1341, comma 2 of the Civil COde, the undersigned declares that he has carefully read and that he openly accepts the points 3 "Use of the Subscription", 4 "Privacy", 6 "Guarantees and Limitations of Responsibility", 8 "Duration and Forfeiture", 10 "Competent Court".
